Terms of Service

1. About NOVA
NOVA (Navigation of Optimal Visit Allocation) is owned and operated by NOVA Health Navigator, a company incorporated in Canada. NOVA provides a digital health navigation service designed to help Nova Scotians identify the most appropriate level of care for their symptoms — including emergency departments, walk-in clinics, pharmacists, or self-care at home.
NOVA is not a licensed healthcare provider. NOVA is not affiliated with Nova Scotia Health, the Nova Scotia Department of Health and Wellness, or any government body, unless explicitly stated.
2. Not Medical Advice
The information, recommendations, and guidance provided by NOVA are for informational and navigation purposes only. Nothing on NOVA constitutes:
- Medical advice, diagnosis, or treatment
- A substitute for consultation with a qualified healthcare professional
- An endorsement of any specific healthcare facility, provider, or treatment
Always seek the advice of a physician, nurse, pharmacist, or other qualified health provider with any questions you have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you read on or through NOVA.
3. Eligibility
NOVA is intended for use by residents of Nova Scotia and Atlantic Canada. You may use NOVA on behalf of another person, including a child. By using NOVA you represent that you have the legal authority to accept these Terms on behalf of yourself and any person for whom you are using the service.
4. Accuracy of Information
NOVA makes reasonable efforts to ensure that information displayed — including wait times, facility details, and care recommendations — is accurate and up to date. However:
- Wait times are predictions based on NS Health public data and may not reflect actual wait times when you arrive.
- Facility information including phone numbers, addresses, and hours may change without notice.
- NOVA's symptom assessment is a navigation aid, not a clinical triage tool validated for medical decision-making.
NOVA does not guarantee the accuracy, completeness, or timeliness of any information on the platform.
5. Limitation of Liability
To the fullest extent permitted by applicable Canadian law, NOVA and its operators, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or reliance on NOVA, including but not limited to:
- Any delay in seeking medical care based on NOVA's recommendations
- Any harm resulting from following or not following NOVA's guidance
- Inaccurate wait times or facility information
- Interruption or unavailability of the NOVA service
Your use of NOVA is entirely at your own risk.
6. Intellectual Property
All content on NOVA — including but not limited to the name, logo, design, codebase, assessment engine, copy, and visual assets — is the exclusive property of NOVA Health Navigator and is protected under Canadian copyright law and applicable intellectual property legislation.
You may not:
- Copy, reproduce, or distribute NOVA's content or code without express written permission
- Rebrand, resell, or create derivative works based on NOVA
- Use NOVA's name, logo, or brand in any way that implies affiliation or endorsement
- Reverse engineer, scrape, or systematically extract data from NOVA
Trademark application for NOVA is pending with the Canadian Intellectual Property Office. Unauthorized use of the NOVA mark is prohibited.
7. Third-Party Data
NOVA displays wait time data sourced from Nova Scotia Health Authority's publicly available information. This data is used with attribution and is subject to NS Health's own terms. NOVA is not responsible for the accuracy of third-party data.
8. AI-Powered Features
NOVA uses artificial intelligence to analyse free-text symptom descriptions and map them to care recommendations. AI outputs are generated algorithmically and have not been reviewed by a licensed healthcare professional. AI-generated recommendations must not be treated as clinical advice.
9. Prohibited Use
You agree not to use NOVA to:
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to NOVA's systems
- Use NOVA for any unlawful purpose
- Interfere with or disrupt NOVA's operation
- Scrape, copy, or harvest data from NOVA in an automated fashion
10. Privacy
Your use of NOVA is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using NOVA you agree to the collection and use of your information as described in the Privacy Policy.
11. Changes to These Terms
NOVA reserves the right to update these Terms of Service at any time. The effective date at the top of this page reflects the most recent version. Continued use of NOVA after changes are posted constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Nova Scotia.
